Home Owner 1, Bank of America 0 - Score One for the Little Guy!

Score one for the little guy!  Take a minute to look at this YouTube video about a Florida couple who turned the tables on Bank of America.

Bank of America mistakenly filed a foreclosure claim against the pair even though they had paid cash for their home in Naples, Florida and had no mortgage at all.

The couple, Warren and Maureen Nyerges,  fought the case in court and won.  They then asked Bank of America to pay for $2,534 in attorney fees. A Collier County judge ruled the bank should pay, but the bank never did.  So what did the Nyerges' do?  They foreclosed on Bank of America! That got the BoA's attention, and the Bank paid up!

Even though the settlement was small in terms of fees, I would imagine the homeowners got satisifaction from the press coverage...way to go.

Until I heard this Rene, I was thinking all these foreclosure challenges were due anyway.  This guy paid CASH!  It's a bank screw up that, had the Bank of America been responsive, should have never gotten to court!

Yes, it does seem that they should be compensated more.  What interesting publicity for B of A...I've seen a lot of info on this topic.

Debbie-Couldn't agree more.

Sally & David-I'm still amazed that BoA was so mismanaged or arrogant that this case made it as far as it did!

Laura...how tuned in are we--Sal was just telling me this item this a.m. as we sat in the garage; actually, he was sitting in "his" chair & I was hanging out by one of the 2 doors from the House.  Loved this item & it is fun to actually 'View' the video.
Let's hear it for having the good business model where someone high up actually 'knows' what it is that is going on within the levels of workers.
[she writes sarcastically]
Can anyone say "Too Big--& Ready to Fail" . Will we ever learn in this country; and will it happen before too many more fall into the cracks of deceit.
Good post.  have a great rest of the week.

[is anyone else having to type the 'what does the graphic say' for each comment--or am I just the lucky one today? OK if I am, just wondered

Kristine-If only they had someone at BoA that had a clue!

William-This couple fought the foreclsoure in court themselves.  When they were talking to an attorney about another matter, he suggested turning the tables.

Barb-I have to agree with you! [yes, that graphic thing is new today]

June-I echo your YES!

Laura, when I first heard about this I was at once angered by BOA foreclosing on a couple with no mortgage...seems like the big guys can do as the wish...and then to hear the couple foreclosed on the bank and won...so how cool is that!

Score one for the little guy! This has to be the feel good story of the year. I do think these folks should have been compensated a considerably larger amount of money. But, in the end, the little guy won, and BofA gets more of the bad publicity they deserve in this case.

Great story.  I've seen Bank of America do similar things - I'm glad to see homeowners take action.
